These terms and conditions govern your use of the Institute of Administrative Management website and services. By accessing our website or using our services, you agree to be bound by these terms.

1. Introduction

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and the Institute of Administrative Management (“IAM”, “we”, “us”, or “our”), established in 1915, regarding your access to and use of our website, services, and products.

By accessing our website at www.instam.org or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

Important: These Terms should be read in conjunction with our Privacy Policy and Cookie Policy, which also govern your use of our website and services. Nothing in these Terms affects your statutory rights under English law, including the Consumer Rights Act 2015.

2. Definitions

In these Terms, the following definitions apply:

  • “Content” means all text, images, audio, video, data, and other materials on our website
  • “Member” means any individual who holds a valid membership with the IAM at any grade
  • “Services” means all services provided by the IAM, including membership, qualifications, certified programmes, CPD courses, and accreditation
  • “Training Centre” means an organisation accredited by the IAM to deliver IAM certified programmes and CPD courses
  • “Qualification” means any Ofqual regulated certificate, diploma, or award delivered through our awarding organisation partners (Qualifi and TQUK)
  • “Certified Programme” means an IAM professional certification programme regulated internally by the IAM
  • “Account” means your registered account on our website or learning platform
  • “Personal Data” has the meaning given under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018

3. Website Use

3.1 Access to the Website

We grant you a limited, non-exclusive, non-transferable licence to access and use our website for personal and professional purposes in accordance with these Terms.

3.2 Acceptable Use

When using our website, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable UK or international laws
  • Attempt to gain unauthorised access to our systems or other users’ accounts
  • Transmit any viruses, malware, or other harmful code
  • Interfere with or disrupt the website’s operation or servers
  • Scrape, harvest, or collect information from the website without permission
  • Impersonate any person or entity or misrepresent your affiliation
  • Reproduce, duplicate, or exploit any part of the website for commercial purposes

3.3 Account Registration

To access certain features of our website, you may need to create an account. You are responsible for providing accurate and complete registration information, maintaining the confidentiality of your account credentials, all activities that occur under your account, and notifying us immediately of any unauthorised use.

3.4 Website Availability

We do not guarantee that our website will be available at all times or without interruption. We may suspend, withdraw, or restrict access to the website at any time without notice. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material.

4. Membership Terms

4.1 Membership Application

Membership applications are subject to approval by the IAM. We reserve the right to reject any application at our discretion. By applying for membership, you confirm that all information provided is accurate and complete.

4.2 Membership Grades

The IAM offers six membership grades: Student (SInstAM), Affiliate (AfInstAM), Associate (AInstAM), Member (MInstAM), Fellow (FInstAM), and Companion (CInstAM). You must meet the eligibility criteria for your chosen grade and may be required to provide evidence of your qualifications and experience.

4.3 Professional Conduct

As a member, you agree to uphold the professional standards and code of conduct of the IAM, act with integrity and professionalism in all professional dealings, maintain and develop your professional competence through continuing professional development, and not bring the IAM into disrepute through your actions or conduct.

4.4 Membership Renewal & CPD

Membership is renewed annually. Members must meet their annual CPD requirements as applicable to their grade. Failure to renew by the due date may result in lapse of membership and associated benefits. Lapsed members may be required to reapply.

4.5 Use of Designatory Letters

Members may use the appropriate post-nominal letters only while their membership remains current. Misuse of designatory letters may result in disciplinary action and potential legal proceedings.

5. Qualifications & Certified Programmes

5.1 Ofqual Regulated Qualifications

IAM qualifications from Level 2 to Level 8 on the Regulated Qualifications Framework (RQF) are delivered through our awarding organisation partners, Qualifi and TQUK. These are subject to regulation by Ofqual. Learners must register through an accredited Training Centre.

5.2 IAM Certified Programmes

IAM Certified Programmes are internally regulated by the IAM and provide professional certifications with designated titles and post-nominals. These are subject to IAM assessment policies and procedures.

5.3 Assessment & Certification

All assessments must be completed in accordance with the relevant assessment policies. The IAM reserves the right to withhold results or certificates where there is evidence of malpractice or maladministration. Certificates remain the property of the IAM and may be revoked in cases of fraud.

5.4 Appeals & Complaints

Learners have the right to appeal assessment decisions and make complaints in accordance with our published policies. For Ofqual regulated qualifications, additional appeal routes may be available through the relevant awarding organisation.

5.5 Reasonable Adjustments

In accordance with the Equality Act 2010, the IAM is committed to making reasonable adjustments for learners with disabilities or specific learning needs. Requests for reasonable adjustments should be made through your Training Centre.

6. Payments, Refunds & Consumer Rights

6.1 Fees

All fees for membership, qualifications, courses, and other services are as stated on our website. Fees are quoted in GBP and are exclusive of VAT where applicable. We reserve the right to change fees with reasonable notice.

6.2 Payment Methods

We accept payment by major credit and debit cards, bank transfer, and other methods as specified. All payments are processed securely in accordance with the Payment Card Industry Data Security Standard (PCI DSS).

6.3 Consumer Rights & Cooling-Off Period

If you are purchasing services as a consumer within the United Kingdom or European Economic Area, you have the right to cancel your purchase within 14 days of the date of purchase (the “cooling-off period”) under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, without giving a reason.

Note: The right to cancel does not apply where you have expressly consented to the service commencing within the cooling-off period and acknowledged that you will lose your cancellation rights once the service has been fully performed. This applies to digital CPD courses that have been accessed or commenced.

6.4 Refund Policy

Refunds are handled as follows:

  • Membership fees: Refundable within the 14-day cooling-off period if no membership benefits have been utilised
  • Course fees: Refundable within the 14-day cooling-off period if the course has not been accessed or commenced
  • Qualification fees: Subject to the policies of the relevant awarding organisation
  • Examination fees: Non-refundable once the assessment date has been confirmed

6.5 Statutory Rights

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. Where services are not performed with reasonable care and skill, you may be entitled to a repeat performance or a price reduction.

7. Intellectual Property

7.1 Our Intellectual Property

All content on our website, including text, graphics, logos, the IAM crest, course materials, qualification specifications, and software, is the property of the IAM or its licensors and is protected by UK and international copyright, trade mark, and other intellectual property laws.

7.2 Permitted Use

You may download and print content from our website for your own personal, non-commercial use only, provided you do not modify or alter the content. You must not use any content from our website for commercial purposes without obtaining our prior written consent.

7.3 Trade Marks

The IAM name, logo, crest, and associated trade marks are registered or unregistered trade marks of the Institute of Administrative Management. You may not use them without our prior written permission, except where explicitly authorised (e.g., accredited centre branding guidelines).

8. User Content

Where you submit content to our website (including directory listings, forum posts, or profile information), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display such content in connection with the provision of our Services. You retain ownership of your content and are responsible for ensuring it does not infringe any third-party rights, contain defamatory, obscene, or unlawful material, or violate any applicable laws or regulations.

9. Data Protection

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how we collect, use, store, and protect your personal data are set out in our Privacy Policy.

By using our Services, you acknowledge that we may process your personal data as described in our Privacy Policy. Where our processing is based on consent, you have the right to withdraw that consent at any time.

10. Limitation of Liability

10.1 Our Liability

To the extent permitted by law, the IAM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from your use of or inability to use our website or Services.

10.2 Maximum Liability

Our total aggregate liability to you for any claim arising out of or relating to these Terms shall not exceed the total amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. Nothing in these Terms affects your statutory rights as a consumer.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us. Termination does not entitle you to a refund of any fees paid, except where required by law or where the cooling-off period applies.

11.2 Termination by Us

We may terminate or suspend your account and access to the website immediately, without prior notice, if you breach any provision of these Terms, you engage in conduct that is harmful to other users or the IAM, we are required to do so by law, or we decide to discontinue the website or Services.

11.3 Effect of Termination

Upon termination, your right to use the website and Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

12. Complaints & Dispute Resolution

12.1 Complaints Procedure

If you have a complaint about any of our Services, please contact us in writing at [email protected]. We will acknowledge your complaint within 5 working days and aim to provide a full response within 20 working days.

12.2 Alternative Dispute Resolution

In accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, we advise that we are not obliged to participate in alternative dispute resolution (ADR) but may choose to do so at our discretion. If you are a consumer in the EU, you may also refer to the European Commission’s Online Dispute Resolution platform.

13. General Provisions

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, this does not affect any mandatory consumer protection rights under the law of the country in which you reside.

13.2 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and the IAM regarding your use of the website and Services.

13.3 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13.4 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

13.5 Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on our website with a revised “last updated” date. Where changes materially affect your rights, we will provide at least 30 days’ notice.
